A bill for an act relating to obscenity, including the exposure of a minor to an obscene performance and admittance of a minor to a premises with obscene performances, establishing a private civil cause of action, and providing penalties.(Formerly HSB 158.)

"Obscene performance" means a visual performance by a person [...] that exposes [...] prosthetics and artificial sexual organs or substitutes thereof [...] The average person, viewing the performance as a whole and applying contemporary community standards regarding what is suitable for minors, would find it appeals to the prurient interest, is patently offensive, and, taken as a whole, lacks serious artistic, literary, political, or scientific value.
The parent or guardian of a minor, or a minor upon attaining eighteen years of age, to whom obscene material has been knowingly disseminated or exhibited [...] may bring a civil action against any person who has knowingly disseminated or exhibited obscene material to the minor, or who engaged in, caused, or allowed a person to knowingly engage in an obscene performance in the presence of the minor.
The minimum award of damages in an action brought pursuant to this subsection shall be ten thousand dollars.
[Bill was previously IA HSB158, which included: "Drag show" means a performance in which all of the following apply: a. The main aspect of the performance is a performer who exhibits a gender identity that is different than the performer’s gender assigned at birth through the use of clothing, makeup, accessories, or other gender signifiers. b. The performer sings, lip-syncs, dances, reads, or otherwise performs before an audience for entertainment, whether or not performed for payment. [...] No minor shall be present at or view a drag show at a place of business. [...] A person over eighteen years of age who knowingly brings a minor to a drag show at a place of business shall be guilty of a Class “D” felony.]
