"Adult cabaret performance", a performance in a location other than an adult cabaret that features topless dancers, go-go dancers, exotic dancers, strippers, male or female impersonators who provide entertainment that appeals to a prurient interest, or similar entertainers, regardless of whether performed for consideration;

A person commits the offense of engaging in an adult cabaret performance if such performance is: (1) On public property; or (2) In a location where the adult cabaret performance could be viewed by a person who is not an adult. 2. The offense of engaging in an adult cabaret performance is a class A misdemeanor for a first offense and a class E felony for any second or subsequent offense.
